FATAL ACCIDENT OLD HOUSTON AT PAYNE
MONTGOMERY COUNTY – In the first three hours of Saturday, two people died in unrelated single-vehicle automobile accidents.
The first crash was reported just after midnight when a Honda Civic was traveling north on Old Houston Road north of Payne Road. According to DPS, the driver lost control and went into a side skid then ran off of the pavement, striking a utility pole and fence, and flipped.
When emergency crews arrived, the driver was tangled in the wreckage and obviously dead. He was identified as 24-year-old David Wayne Mowery (pictured), who lived nearby on Pioneer Trails.
Mowery’s page on the social networking site MySpace.com stated he was a 2003 graduate of Caney Creek High School who worked in the plumbing and was taking college courses in the hopes of one day becoming an architect.
There were no passengers in Mowery’s vehicle.

FATAL CRASH RILEY FUZZEL AT BENDERS LANDING
Around 2:50 a.m., medics responded to another single-vehicle crash on Riley Fuzzel Road, east of Bender’s Landing. An Acura sedan was southbound on Riley Fuzzel when it crossed oncoming traffic went into a ditch and struck a pine tree at a high rate of speed.
The driver, 30-year-old Chad Garett of Houston, was already dead when emergency crews arrived. His passenger, Charles Allen Strickland (age unknown), was transported by ground ambulance to an area hospital then transported to Memorial Hermann Hospital in Houston in critical condition with injuries to his hips and legs, according to DPS.

OLD SECURITY 2 ALARM FIRE
Just before midnight on Saturday, the Cut and Shoot Fire Department responded to a house fire on the corner of Oliver Lane and Main Street, south of SH 105 East in Security.
Upon arrival, Cut and Shoot firefighters saw flames through the roof and requested a second alarm for manpower and water.
Grangerland, North Montgomery County, and Splendora Fire Departments responded, with the temperature hovering around freezing.
The two-story home sustained heavy damage but was not a total loss. There were no injuries.
The Montgomery County Fire Marshal’s Office is investigating the cause of the fire.
WILLIS-CPL JOEY LOGAN RETURNS HOME
As scheduled the private jet carrying Cpl. Joseph Logan arrived at Bush International Airport at 10 a.m. Monday morning. As the family sat on the tarmac facing the aircraft as it taxied in Houston Police, Patriot Guard, Montgomery County Sheriff’s deputies, Precinct 2 and Precinct 3 deputies stood at attention. Houston Fire Department with their airport crash trucks positioned themselves and created an arch of water as the aircraft passed under it.
Within fifteen minutes Cpl. Logan’s casket was taken off the aircraft and with fellow Marines carried the casket to the waiting hearse.
Normally escorts from Bush Airport to Montgomery County are forced to use the Beltway to I-45 and north. In the past, this has been a dangerous situation as the long slow-moving procession entered Interstate 45 and attempted to move to the left lane. With law enforcement escorts the procession was taken up the Hardy Toll Road thanks to the Harris County Toll Road Authority. As they approached one of the toll plazas the flags had been brought down to half-mast and the employees stood out in front saluting as the procession passed. A Union Pacific conductor moving southbound on the tracks was seen waving an American flag in his red white and blue striped shirt.
Moving at speeds less than 40 miles per hour due to the flags on the backs of the motorcycles and the wind the procession moved slowly up the toll road to I-45. As the procession entered Montgomery County several law enforcement units, fire trucks, MCHD units, and DPS lined over a mile of the freeway as officers saluted Cpl. Logan. Many civilians also pulled over on the shoulders standing at attention as they passed.
Needham Fire Department lined the overpass of FM 1488 with men and equipment as did several other departments along the way. The management of the Outlet Mall at League Line and I-45 displayed Cpl. Logan’s photo on their electronic billboard.
Arriving in Willis the North Montgomery County Fire Department and Conroe Fire departments set up their ladder trucks with an American flag hanging as the procession passed under it. In addition, hundreds of people holding signs and flags stood in tribute to Cpl. Logan.
Continuing down FM 1097 Montgomery Fire Department and many other residents lined the roadway through the entire distance to Cpl. Logan’s family home on Midway Drive. Making one last trip past his home the procession moved to Sam Houston Funeral Home on FM 1097.
The viewing for Cpl. Logan is scheduled for Tuesday at Sam Houston Funeral Home with the funeral Wednesday at 3 p.m. at the Willis Community Center,.

SWEARINGEN EXECUTION WARRANT RECALLED
In less than a month Larry Swearingen was to executed for the murder of Melissa Trotter a college student who vanished December 8, 1998, and was found January 2, 1999, in the Sam Houston National Forest by hunters–in an area that had been already searched three times. She had been strangled with one leg of a set of pantyhose. Around her neck and face, there was some decomposition from maggots as well as evidence of rodent scavenging. She was clothed but her shirt had been bunched up around her neck, and though her torso was bare, it showed no evidence of having been scavenged by the wild pigs, crows, raccoons, or vultures that live in the forest. Her corpse was not bloated, and police reported no foul smell. In fact, the hunters had initially thought she was a mannequin. The body appeared to have been in its final resting place for only a short period of time.
Swearingen, an ex-con who was working as an electrician, had met Trotter on December 6 and asked her out on a date. She stood him up the next day, but on December 8 they rendezvoused on campus. That same day she disappeared, making Swearingen one of the last people to see her alive. Three days later, he was arrested for outstanding traffic warrants and put in jail, where he remained after becoming a suspect in Trotter’s disappearance. When her body was found, Swearingen had already been in jail for three weeks.
Though no one saw Trotter leave the campus with Swearingen, the state was able to stitch together a tenuous narrative that had Swearingen kidnapping her in his truck, taking her to his trailer, raping her, killing her, and dumping her in the forest. (In order to get the death penalty, prosecutors had to prove murder in tandem with another felony, such as kidnapping or rape.) The motive? Prosecutors brought forward testimony from construction worker pals of Swearingen’s who said he had been furious at being stood up. As for proof about the kidnapping, there were witnesses who saw the two together on campus earlier that day, and there were fibers found on her jacket that “appeared to be” from Swearingen’s jacket and other fibers found on her and her clothes that were “similar to” carpet fibers from his trailer and truck seat.
One thing was another leg of pantyhose found in the trash outside his trailer four days after Trotter’s body was located.
Swearingen has skipped execution at least three times already.
Several weeks ago the defense team, most of which consist of out of state attorneys filed a motion for six items to be tested for DNA. They were citing Chapter 64 of the Code of Criminal Procedures which the language had been changed in 2011. Prior to that in 2010 the Court of Criminal Appeals, the highest court in the state denied the defense motion for additional testing.
Back during the case, the prosecution had enough evidence without the additional six items which included some clothing, cigarette butts, and pantyhose. The defense didn’t request the testing than either.
When the new motion was filed District Attorney Bret Ligon immediately agreed to an expedited DNA test of the materials with the scientist and lab of the defense choice. They said it could be completed within 10 days without having to delay the execution date.
That wasn’t enough for the defense attorneys that the court says thrive on delaying executions. According to the lab which was chosen for the tests, the entire assignment could actually be completed in a few days. The long waits for most DNA are due to a backlog of agencies but paying for the service can move it to the front of the line.
With new motions and arguments, the case could drag on for more than 6 months. When Judge Case recalled the execution warrant the District Attorney’s Office asked for a new one be set for August 28, 2013. Judge Case refused.
Melissa’s mother has gone through a proceeding for 14-years and there has not been any closure.

GRANNY DOPE BUST
Members of the Montgomery County Precinct 4 Constable Kenneth “Rowdy” Hayden’s Office raided and arrested a familiar face Thursday.
Around sunset, Pct. 4 Deputies went to the 12600 block of Anmar Drive in Splendora to execute a search warrant on a known drug dealer, who is well-known to that agency. Constable Hayden said it was the third time they have dealt with 66-year-old Joyce Phillips since Hayden took office in 2009.
In 2011, Precinct 4 executed a search warrant at Phillips’ prior residence, where she was arrested for Possession of a Controlled Substance along with her boyfriend, 55-year-old Phillip Lewis.
In 2012, Precinct 4 Arrested Joyce Phillips at the same residence for Manufacture / Delivery of a Controlled Substance, and that arrest cost her more than legal fees.
“With the cooperation and help of the Montgomery County District Attorney’s Office, we (the county and the DA’s office) seized her property,” Hayden said. “It was sold and she moved on.”
“A couple of years later, she’s back and we’re having to deal with the same activity again,” he said.
On Thursday, Phillips was charged with three counts of Manufacture / Delivery of a Controlled Substance.
Philip Lewis was arrested and charged with two counts of Manufacture / Delivery of a Controlled Substance.
Hayden said Phillips does not own her residence this time, but her other assets would again be seized.
“We’ve been in constant communication with the District Attorney’s Office,” he said. “It’s time for the justice system to take care of this problem in our community.”
Hayden said his office has invested many manpower hours and a lot of taxpayer dollars into stopping Phillips from selling prescription pain pills, including Soma and Hydrocodone. The constable said their investigation indicated Phillips had people who obtained the pills and then sold them to her so she could resell them for a profit.
“The problem with that is, she could be selling to anybody,” Hayden said. “She doesn’t care – If you’ve got money, she will sell you pills.”
“If it’s your kids, she doesn’t care,” he said.
While Precinct 4 was on scene executing the search warrant, about a half dozen vehicles showed up, presumably to buy illegal narcotics. Some of them already had warrants.
Investigators seized a substantial amount of cash and removed vehicles from the property.
“She doesn’t work, but has numerous vehicles,” Hayden said. “Unfortunately, helping people self-destruct is a lucrative business.”

SHADY LANE HOMICIDE
January 30, 2016 – Houston police have released surveillance photos of two possible suspect vehicles wanted in connection with the fatal shooting of a man at 10300 Shady Lane about 1:50 a.m. today (January 30).
The victim, Misael Arrellanes, 39, of the above address, was pronounced dead at the scene.
HPD Homicide Division Sergeant M. Holbrook and Officer K. McDonald reported:
Neighbors and relatives of Mr. Arrellanes reported hearing a gunshot in the late night/early morning hours. A neighbor looked outside and saw Arrellanes lying in the parking lot with a gunshot wound. HPD patrol officers and HFD paramedics responded to the scene where paramedics pronounced Arrellanes deceased.
Investigators would like to speak with the owners of two vehicles seen leaving and entering the apartment complex at the time of the shooting. One vehicle, described only as a Dodge Caravan, entered the complex parking lot as a light-colored Chevrolet HHR was leaving the location. Surveillance photos of the vehicles are attached to this news release.

Just after 3 am a Houston Police officer on routine patrol drove upon an accident that had just happened. A Ford Nissan pickup was eastbound on the McKay Bridge when a male crossed his lane on a bicycle. The driver who was traveling at the posted 55 mph was unable to avoid the bicycle. The 50-tear-old male on the bicycle was pronounced dead on the scene. He is believed to be a homeless man who frequents the area. Police found no signs of impairment of the driver of the truck. No charges are expected. The bridge was open to shoulder lanes only until just after 9 am.

FATAL CRASH BELTWAY 8 AT I-45
Just after 2am Saturday morning Houston Police were dispatched to a major accident on the elevated section of Beltway 8 eastbound to I-45 southbound. They arrived to find a Dodge Charger had lost control and flipped over killing the Hispanic male driver. The elevated section was closed until after daylight for cleanup and investigation.

A family of three escaped with the clothes on their back and their two beloved birds Saturday night just after 10 pm. Houston firefighters arrived to find fire showing through the roof of the single-story home on Briarstem near Piping Rock just off Highway 6. There were no injuries. The home suffered heavy smoke and fire damage.

FM 525 SHOOTING
Just after 10pm Saturday night a male driving east on FM 525 near the Campbell Stadium in the Aldine area was shot. He was able to drive to the McDonalds at FM 525 and Aldine Westfield where police were called. He was transported to Ben Taub Hospital in serious condition. Both front windows were shot out of the Lincoln and one bullet was lodged in the trim of the passenger door. Harris County Sheriff’s Office is investigating.

COLORADO MAN DROWNS ON LAKE CONROE WHILE FISHING
A 70-year-old man who decided to come down to Lake Conroe for a few weeks of fishing drown this morning. Just after noon Montgomery County Precinct, 1 Constable Office Lake Patrol recovered the body of the man. He and his family came to Lake Conroe to fish. The family went to eat some breakfast, as he continued to fish. When they returned he was missing. That is when they saw him in the water. They say it looks like he may have fallen off the dock into the water. He did have reported prior medical issues. Montgomery County Precinct 1 Justice of the Peace Wayne Mack ordered Eickenhorst Funeral Directors to transport the victim to the Montgomery County Forensic Center for autopsy. According to Constable Phillip Cash no foul play is expected.

MAN SENTENCED IN PATTON VILLAGE OFFICER DEATH
Patton Village Sgt. Baumgartner lost his life along with 11-year-old Adan Hilario in a crash at FM 1485 and SH 242 on Father’s Day of 2016. Garrett William Nee was found directly responsible for the crash when he decided to flee from the Patton Village Officer at speeds close to 100 mph that day. After a week of testimony, last week, the jury found Nee guilty of 4-counts of evading and causing serious bodily injury. Also, two counts of evading causing the death of Baumgartner and Hilario. Monday the jury heard from some experts and others for the punishment phase of the trial. After 4-hours on Tuesday, the jury came back with a 15-year sentence. The maximum allowed by law was 20. Nee, who has been in the Montgomery County Jail since June 19, 2016, will have to serve at least 7-1/2 years before being eligible for parole. Those 19 months will be credited to the sentence. After the verdict, Donna Baumgartner took the stand and told Nee that she forgave him. Chloe Baumgartner, 6, will miss her father, Dona said, she won’t have him to walk her down the aisle, see her graduate, or meet her first boyfriend. However, Chloe did gain several new friends with the Hilario family who lost their son.

BIRNHAM WOODS HOMICIDE
On Tuesday, January 30, 2018, at approximately 3:55 pm, deputies with the Harris County Pct 4 Constable’s Office responded to a shooting in the 4400 block of Adonis Drive in northeast Harris County. Upon arrival, they discovered the victim, an 18-year-old male, identified as Diego Andrade, 18, inside his vehicle deceased from an apparent gunshot wound. Deputies spoke with witnesses at the scene who stated the victim was being robbed by two males at the time of the shooting. Witnesses described the first male as a Hispanic male, 5’7”, light complexion, thin build wearing a grey hoodie with grey bottoms. The second male was described as a black male, 6’1”, dark complexion, medium build, wearing a black hoodie with a white print and grey bottoms. Both males appeared to be in their late teens to early twenties and were last seen running westbound from the scene.
The Harris County Sheriff’s Office Homicide Unit was called to the scene to conduct the investigation. The investigation is on-going at this time and anyone with information is urged to call Crime Stopper at 713-221-TIPS (8477).

SAN JACINTO COUNTY FIRE FATAL
At 227am North Montgomery County Fire responded to assist San Jacinto County on a house fire with a victim trapped on Jones Road near the Montgomery/San Jacinto County line. Units arrived to find a single story wood frame structure fully involved with roof collapse. Firefighters attempted to enter the structure but were forced out by the heat. Water supply was an issue being the home is in a very rural area of the county, the nearest water supply was several miles away. Tankers from Shepherd, North Montgomery County, and Punkin-Evergreen Fire Departments shuttled water for several hours. The San Jacinto Fire Marshal is now on the scene along with the San Jacinto County Sheriffs Office. The body of an elderly male was recovered from the structure. Jeff Williams with the San Jacinto County Fire Marshal’s Office is investigating the blaze along with the Texas State Fire Marshal’s Office.

HARRIS COUNTY PRECINCT 1 PURSUIT
About 8 pm Harris County Precinct 1 attempted to make a traffic stop of a possible intoxicated driver in a Ford Explorer on East Loop 610 at US 59. The vehicle fled to FM 1960 then through Humble to West Lake Houston Parkway then north into Montgomery County into a construction zone of a new subdivision. The vehicle got stuck in the mud when officers approached the driver and the passenger refused to give up and continued to try to get unstuck. The windows were broken and they were tazed. The female who as she was being cuffed stated she wasn’t going to stop until she got to Alabama. She was placed in custody. The male passenger was transported to Kingwood Hospital to get checked out. Several Precinct 1 and 4 patrol cars became stuck in the mud also. Most of the deputies were covered in mud. The vehicle with handwritten tags is believed to be stolen from Alabama and the driver is believed to have warrants from Alabama.

FOSTORIA STOLEN TRUCK CRASH
Just after 6 am Thursday Daniel Lazo, the owner of Daniels Tree Service on SH 105 at Old 105 was on his property warming trucks up and checking equipment for the day. It was then a white male in a brown jacket ran across his property, jumped into his 2011 Black Dodge truck which was loaded with equipment and hooked to a goose-neck trailer with a Kabota excavator. The male then drove off the property and onto SH 105. Lazo jumped into another truck and headed down Old 105 hoping to get ahead of the truck while he was on the phone with 911. as his nephew jumped into a blue 2006 Dodge 350 and followed behind. Lazo’s nephew spotted the truck east on SH 105 and got behind it following it. Liberty County had been alerted and was set up at Loop 105 and SH 105. As the stolen truck approached Fostoria Road it turned south at a high rate of speed, Lazo’s nephew continued to follow. Just before Morgan Cemetery Road, the driver of the stolen truck passed a Chevrolet Avalanche that was southbound striking it with the trailer. The Avalanche crashed into the ditch. The driver with the stolen truck continued south. Just as they approached the intersection of Morgan Cemetery Lazo’s nephew attempted to pass the stolen truck in hope of cutting him off at the intersection. However, the driver of the stolen truck swerved into Lazo’s nephew striking his vehicle but also causing the stolen truck to jack-knife into the ditch striking Lazo’s nephew’s truck again head-on. The driver of the stolen truck was believed to have been trapped but when EMC Firefighters cut the windshield out the driver was gone. Witnesses say he ran into the woods. Lazo’s nephew escaped injury. Fostoria Road was closed for several hours as DPS and MCSO investigated the incident. Duty to motor oil dumped into the ditch requiring HAZMAT International to respond. Texan Towing and Saddle Creek Towing removed the vehicles and equipment from the scene.

KINGWOOD COLLEGE REPORTED SHOOTER
A report of shots being fired on the west side of the Kingwood College Campus has not been validated. Multiple Police agencies responded including New Caney ISD Police, HPD, Montgomery County Sheriff’s Office, Precinct 4 Constables responded when someone called in that a suspect had a gun near the auditorium with than hearing possible shots fired. Units are searching the area and coming up empty-handed. Students on the West Campus and officers on campus report not hearing any shots. Only one call was received. Reports came from the music hall.

Chief Paul Willingham, Chief of Police for Lone Star College said the first call originated from a young woman in a parking lot calling a friend who was in a building on the campus that there were multiple shots fired. That girl then calls 911 to report it. The 911 call was directed to the Montgomery County Sheriff’s Office who in the initial response included almost all East County Deputies, Precinct 4 Deputies, Patton Village, New Caney ISD Police, Roman Forest, DPS and Splendora Officers. Units arrived and immediately started trying to locate the person on the phone. With such a large campus that took a bit as they slowly worked their way into the campus area. Several others outside heard the shots also. Once everything was secured outside the student were escorted outside leaving belongings behind and hands in the air. Once students were out officers moved in to start a room to room check looking in every crevice possible. At this point, Harris County Sheriffs Office Mobile Command, SWAT and Hostage Negotiation Team also arrived. Houston Police were also alerted as was Harris County Precinct 4 Constables and Humble Police. Two students required medical treatment due to anxiety issues from the incident. Once the building was clear students were allowed back in to get their belongings. At the conclusion, it has not been determined if there were even shots fired or a vehicle backfire. If there were, it could possibly have been hunters in the thousands of acres of woods near the campus as it was said there were about 20 shots. With the cold day, the sound of a shot could travel long distances.
